End User License Agreement
This End User License Agreement (“EULA”) is a legal agreement between you (“you”) and Cal AI (“Licensor”) for the Cal AI mobile application, related app updates, and app-delivered software components (“Licensed Application”). By installing, accessing, or using the Licensed Application, you agree to this EULA. If you do not agree, do not install or use the Licensed Application.
Relationship to other terms
This EULA applies to the software license for the App. Your use of the broader Cal AI services is also governed by our Terms of Use, and paid features are governed by our Subscription Termswhere applicable. If there is a conflict, the more specific terms apply to the relevant subject matter.
Scope of license
Subject to this EULA, the Terms of Use, and the rules of the application store from which you downloaded the App, Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Licensed Application on compatible devices that you own or control, solely for personal, non-commercial use. The Licensed Application is licensed, not sold.
License restrictions
You may not, except where applicable law gives you a non-waivable right:
- Copy, redistribute, sell, rent, lease, sublicense, or commercially exploit the Licensed Application.
- Modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive source code.
- Remove, obscure, or alter proprietary notices, branding, security features, or usage limits.
- Use automated access, scraping, bots, or scripts to bypass quotas, subscription limits, or app flows.
- Use the Licensed Application to develop competing services, models, datasets, or benchmarking systems without consent.
- Use AI outputs as verified medical, clinical, or professional nutrition advice.
- Use the Licensed Application in a way that violates law, platform rules, third-party rights, or our Terms of Use.
Device, network, and platform requirements
The Licensed Application may require a compatible device, supported operating system, network access, camera or photo permissions, notification permission for reminders, and access to our API or third-party providers. Some features may be unavailable if permissions are disabled, your device is unsupported, the network is unavailable, or a platform provider changes its requirements.
Data and privacy
The App may process food photos, scan results, device/session identifiers, optional Google account information, preferences, diagnostics, and support information as described in our Privacy Policy. Review that policy to understand what is collected, how AI photo processing works, retention, deletion, and your controls.
AI and nutrition output
The Licensed Application may generate nutrition estimates using artificial intelligence. Results may be inaccurate, incomplete, or unsuitable for medical or dietary decisions. You are responsible for reviewing outputs and confirming important values through reliable sources or qualified professionals.
Apple App Store additional terms
If you obtained the Licensed Application from the Apple App Store, your use is also subject to Apple’s Licensed Application End User License Agreement and Usage Rules, except that Licensor, not Apple, is solely responsible for the Licensed Application and its content. Apple has no obligation to furnish maintenance or support for the Licensed Application. Apple is not responsible for addressing claims relating to the Licensed Application or your possession or use of it, including product liability claims. In case of failure to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price where applicable; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
Google Play additional terms
If you obtained the Licensed Application from Google Play, Google LLC and/or its affiliates may be third-party beneficiaries of this EULA where required by Google Play’s terms. Your use of Google Play billing, downloads, updates, refunds, and subscription management is governed by Google Play terms and policies.
Updates
Licensor may provide updates, patches, bug fixes, compatibility changes, security improvements, or new versions of the Licensed Application. Updates may be installed automatically depending on your device or app store settings. Continued use after an update constitutes acceptance of the updated software and applicable terms.
Third-party and open-source components
The Licensed Application may include third-party or open-source components. Those components may be subject to their own license terms, notices, or attribution requirements. Nothing in this EULA limits rights you may have under applicable open-source licenses for those components.
No maintenance obligation
We may provide support, updates, or maintenance at our discretion or as required by law or platform rules. We do not guarantee that every device, operating system version, or app version will remain supported indefinitely.
No warranty
THE LICENSED APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, SECURITY, ACCURACY, AND FITNESS OF AI OR NUTRITION OUTPUTS FOR YOUR NEEDS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE LICENSED APPLICATION. OUR TOTAL LIABILITY WILL BE LIMITED AS SET FORTH IN THE TERMS OF USE.
Termination
Your license ends automatically if you fail to comply with this EULA or the Terms of Use. Upon termination, you must stop using and remove the Licensed Application from your devices. Termination does not automatically cancel subscriptions managed by an app store; you must cancel those through the applicable Platform. Sections intended to survive termination, including license restrictions, intellectual property, disclaimers, and limitations of liability, will survive.
